Exemptions in Tennessee
Articles with regard to what assets Tennessee residents can "exempt" from the claims of creditors, both in and out of bankruptcy proceedings.
If you already have, or can foresee, financial difficulties DO NOT attempt to make use of any exemption, or transfer ANY property or asset, without consulting a lawyer. You will almost certainly make your problems more difficult to deal with and may commit a criminal act!
Tennessee's Homestead Exemption
These Articles deals with T.C.A. § 26-2-301, Tennessee Homestead Exemption. The exemption amount varies.
1) A single debtor, or a married debtor individually (i.e. without the spouse) is entitled to: $5,000;(a)
2) A married couple jointly is entitled to: $7,500;(a)
3) A single debtor who is at least 62 years old is entitled to: $12,500;(e)
4) A married couple jointly, both of whom are at least 62: $25,000;(e)
5) A married couple jointly, one over 62, and one under 62: $20,000;
6) A single person with custody of at least one minor child: $25,000;(f)
7) A married couple with custody of a minor child, (f): the proper reading of this new subsection is in dispute. The Middle District of Tennessee reads the this new sub-section to provide for a $50,000 homestead exemption; the Eastern District of Tennessee $-0-.
